Tyson Foods appeals $7.3 million judgment awarded to defrauded poultry growers | CF

COMMENT: Unhappy with the decision against them, Tyson is appealing the legal spanking they got a few weeks ago in court.

A number of poultry farmers convinced a jury in McCurtain County, Oklahoma that Tyson was not treating them fairly and bullying them into getting unneeded upgrades to their farm.

FROM THE ARTICLE: The lawsuit charged fraud, negligence and violations of the Oklahoma Consumer Protection Act by Tyson in its dealings with the growers.

Benson said his clients received inferior chickens and bad chicken feed from Tyson as part of a system that favored some growers and strived to keep others in debt.

“Basically what has happened is we had some local people who felt like they weren’t getting a fair shake from Tyson,” he said.

“We were able to show through some of Tyson’s own documents … that some of this was taking place,” he said.

In their first amended complaint, the growers alleged that Tyson took part in a series of improper acts designed to favor its interests.

The allegations include misrepresentation of certain contract provisions and inducement of growers to unnecessarily finance expensive improvements to their facilities to satisfy Tyson.

Growers who did not upgrade their facilities were penalized with inferior birds and feed, Benson said.

“Anybody that’s real familiar with the chicken industry knows that’s something that has always alleged to occur, and we felt like that it has,” he said.

    Poultry growers are going broke because of 2 years of reduced placement of baby chicks which affects total number of pounds produced on any given farm. This was done in order to create a limited supply in order for the poultry companies to raise prices and return to profitbility. Now it appears all poultry companies are operating in the black however the growers will not recover their 30% reduction in income because of time lost. Dont jump into poultry growing until it’s profitable again. Signed, Farm For Sale!
