A Fayetteville man has been arrested today in connection with aggravated assault on a law enforcement officer.
Washington County deputies responded to a domestic disturbance in progress at 6217 Concord Road, Fayetteville Arkansas.
A female caller told officers her husband, Justin Patrick Hughes, W/M, (age 40), was outside of their residence firing a shotgun and shouting that everyone was dead. When deputies arrived on scene they located Hughes seated in his 2005 Dodge pickup truck backed down a lane adjacent to the residence.
When deputies attempted to make contact with Hughes, he exited the vehicle armed with a 20 gauge pump shotgun.
Hughes worked/racked the action on the pump shotgun and aimed it in the direction of the deputies. A deputy fired at Hughes and struck the shotgun he was holding.
Hughes fell to the ground and then stood up and entered his truck and attempted to flee from the deputies. Hughes found the driveway was blocked by police vehicles and attempted to drive his vehicle around the residence into a heavily wooded area.
In doing so, he struck a tree head on with his vehicle. Hughes then exited the vehicle and ran towards the house.
Once there, he kicked in the front door of the residence where the victim from his earlier domestic was located with their 11-year-old child.
Deputies attempted again to arrest Hughes, but he resisted arrest and was tased. After a brief struggle deputies were able to take Hughes in custody.
He was transported to the Washington County Detention Center where he was charged with Aggravated assault (five counts), Class D Felony, Terroristic threatening Class D Felony, Possession of firearms by certain persons, Class D Felony, Endangering welfare of minor 1st degree, Class D Felony, Domestic Battery 3rd degree, Felony (Second offense), Resisting Arrest, Terroristic Act, Class B Felony, DWI and refusal to submit to a chemical test (Misdemeanors).
Hughes has criminal history for aggravated assault, robbery, kidnapping, obstructing the police and domestic violence.
The Washington County Sheriff’s Office OPC (Office of Professional Conduct) is conducting an internal investigation in order to find out if departmental policies were followed.
The deputy involved in the shooting is Sergeant Carol “Arlo” Guthary.
He has been placed on administrative leave pending the outcome of the investigation. Hughes received a minor injury to his right index finger.
It is unknown if the injury was the result of the officer shooting or if it occurred in the later struggle. The investigation will attempt to determine the cause of the injury, which required no medical attention.
